Welcome to NOVA MEMORIAL!

1. GENERAL PROVISIONS

These Terms of Use ("Terms") govern your use of the "NOVA MEMORIAL" platform and provide information about the services and functionalities of NOVA MEMORIAL ("Services"). The Terms also govern how NOVA MEMORIAL uses information and content to show you advertisements and other commercial and sponsored content.The service of NOVA MEMORIAL is part of the products and services provided by "NOVA MEMORIAL" EOOD, UIC 207794622, with its registered office and address at: Sofia, 1700, Marin Todorov St. No. 6A, floor 6, apt. 17 ("Nova Memorial"). By creating an account on NOVA MEMORIAL or using NOVA MEMORIAL, you declare your agreement with these Terms.These Terms of Use constitute a contract for the use of the Services between you and "NOVA MEMORIAL" EOOD. It is important to understand your responsibilities and the limitations of the NOVA MEMORIAL services you choose to use. Our services are diverse, and as a result, additional specific terms and/or requirements may apply to the services or certain components thereof. If this is the case, these specific terms and/or requirements must be met to use the Services to the extent you desire.Please use NOVA MEMORIAL in good faith and within the legal framework. Before you start using NOVA MEMORIAL, please familiarize yourself with and accept these Terms.BY USING ANY PART OF NOVA MEMORIAL, YOU AGREE TO BE BOUND BY AND BECOME A PARTY TO THESE TERMS OF USE.

2. DEFINITIONS

   For the purposes of these Terms of Use, the following terms shall have the following meanings:
• "Nova Memorial" means "NOVA MEMORIAL" EOOD, UIC 207794622, with its registered office and address at: Sofia, 1700, Marin Todorov St. No. 6A, floor 6, apt. 17, phone: 0898578545.
• "Service(s)" means the services and functionalities of NOVA MEMORIAL developed and/or offered by Nova Memorial and accessible at www.novamemorial.com, www.novamemorial.bg including the online store available on the Platform.
• ​"User" means a user of the Services who has a registered account on NOVA MEMORIAL.
• ​"Subscribed User" means a user of the Services who has a registered account on NOVA MEMORIAL and has paid at least one subscription fee according to the chosen subscription plan for using the Platform.
• "NOVA MEMORIAL" or "Platform" means the internet platform for communication and sharing of content available on the website www.novamemorial.com , www.novamemorial.bg
• "Account" means a user's account on NOVA MEMORIAL.
• "Terms" means these Terms of Use together with all appendices thereto, which constitute a contract between Nova Memorial and the Users for the use of the Platform. The Terms govern the rights and obligations of the users and Nova Memorial.
• "Party" means Nova Memorial or the User.
• "Parties" means Nova Memorial and the User.
• "Third Parties" means other persons, organizations, and authorities besides Nova Memorial and the User.

3. WHAT IS NOVA MEMORIAL

   We provide you with the NOVA MEMORIAL Service, which includes all products, features, applications, services, technologies, and software of NOVA MEMORIAL that we offer to enable all Users to post and share content related to their own memories (autobiographies), create digital memorial books, share memories of deceased relatives and ancestors, and preserve family heritage (online memorials) for communication with other Users of NOVA MEMORIAL as well as for exchanging information. We also offer an innovative option for your biography and memories of your relatives to never be deleted from their tombstones and plaques through our special memorial plaques containing a unique QR code. NOVA MEMORIAL allows you to use the following features and functions:
• Offering personalized options for creating, communicating, discovering, and sharing memories of deceased relatives and ancestors, family trees, and permanently preserving family heritage. NOVA MEMORIAL offers different types of profiles and functions to help you create, share, and build lasting memories of your deceased relatives and ancestors on NOVA MEMORIAL. We provide you with the opportunity to connect with other users and share content while preserving your memories. To ensure these functionalities of NOVA MEMORIAL, we develop systems that help you create, join, and share content that is important to you. Part of this involves highlighting content, features, offers, and profiles that you may be interested in and offering ways you can use NOVA MEMORIAL.
• Promoting safety, integrity, and security on NOVA MEMORIAL. We develop and use tools and offer opportunities to Users of NOVA MEMORIAL to help ensure the safe and secure use of NOVA MEMORIAL.
• Developing and using technologies that help the growth of NOVA MEMORIAL and creating and sharing positive content. Organizing and analyzing information is a fundamental part of our Service. A large part of our Service involves creating and using innovative and contemporary technologies that help us personalize, protect, and improve NOVA MEMORIAL. Technologies such as artificial intelligence and machine learning provide us with the ability to use complex processes in NOVA MEMORIAL that enable us to provide many functional solutions for communication and exchange of goods and services on NOVA MEMORIAL. Automated technologies also help us ensure the functionality and integrity of NOVA MEMORIAL.
• Communicating with you. We may need to send you messages, such as emails or notifications on NOVA MEMORIAL, to respond to you or inform you about Service-related issues (in emergencies), surveys, or our Terms and policies, new features, etc.
• Ensuring access to our Services.
• Connecting you with businesses, products, and services in ways that facilitate your orders and access to information, inquiries, prices, and other components of the goods and services you wish to use and acquire. Depending on your choices and settings, we use information from NOVA MEMORIAL as well as from external partners to personalize your experience on NOVA MEMORIAL, including by showing you advertisements, offers, and other sponsored content that we believe will be relevant to you. We strive to make this content as relevant as all other experiences on NOVA MEMORIAL.
• Providing the Services and improving NOVA MEMORIAL. We use the information we have to develop, test, and improve our Platform and collaborate with others in the field of research to make our Platform better and contribute to a positive experience for Users on NOVA MEMORIAL. This includes analyzing the information we have about Users and understanding how people use our Services, such as conducting surveys and testing and troubleshooting new features.

4. ACCOUNT ON NOVA MEMORIAL

To use the Service, you must register your own account as a User on NOVA MEMORIAL. You can register your account by accessing the NOVA MEMORIAL website from your device or accessing the Platform via a web browser and entering the required mandatory information in the registration form, namely: a valid email, password, first and last name, and username (nickname). You can also use other technical means to create an Account as long as they are allowed on the Platform, such as creating an Account via Facebook or Google account. After entering the necessary information and before completing your account registration, you must agree to these Terms of Use and NOVA MEMORIAL's Privacy Policy.You will receive an electronic message containing a link to follow to confirm your account on NOVA MEMORIAL at the email address you provided in the registration form (or the email associated with your Facebook or Google account used during registration). Once you confirm and activate your Account, you will receive an electronic message confirming the registration of your Account on NOVA MEMORIAL.Once you have successfully activated your Account on NOVA MEMORIAL, you can access it by entering your email and access password (or via your Facebook or Google account used during registration on NOVA MEMORIAL).You can enter and update your data and information about yourself in your account at any time, such as a photo, personal information about you and your interests (biography), contact details, delivery addresses, etc.You are required to provide true and up-to-date data on NOVA MEMORIAL in all cases of using the Services. Any person who has a registered account on NOVA MEMORIAL is responsible for inaccurate and/or incomplete filling of data and information on the Platform. NOVA MEMORIAL assumes no responsibility if a User or Third Party has provided false and/or incorrect data at the time of registration or at a later stage, including in all cases where access to NOVA MEMORIAL cannot be achieved or is temporarily or permanently suspended due to incorrect contact details or other incomplete or false information.At its discretion, we may refuse to provide you with the Services by refusing to register an account on NOVA MEMORIAL or by deleting/closing/deactivating an already registered account, including in all cases where there are suspicions that a User does not comply with the Terms of Use and policies of NOVA MEMORIAL (for example, is a minor, incapacitated, has entered false data, or for any other reason is not entitled to use NOVA MEMORIAL or does not meet the requirements of the law, the Platform, and/or these Terms) or has violated these Terms, applicable law, or the rights and legal interests of other Users and/or Third Parties in connection with the use of NOVA MEMORIAL. In such a case, NOVA MEMORIAL is not obligated to notify, warn, compensate, or preserve or restore the information in the User's Account.You are responsible for all actions performed through or resulting from the use of your account on NOVA MEMORIAL. You are obligated not to provide access data to your Account to persons who you do not want to perform actions on your behalf and at your expense. If you provide access to your account on NOVA MEMORIAL to a given person, we will consider that you have authorized them to perform actions on your behalf and at your expense. In this case, you are responsible for the actions of this person as if they were your own.You have the right to delete your Account on NOVA MEMORIAL whenever you decide. The account deletion functionality is available in the section with your data. Please note that before deleting your Account, you must personally delete each separate memorial page, digital memorial book, and other content you have created and is available in your Account or transfer all available content to another Account on the Platform.If you delete your account on NOVA MEMORIAL and later decide to use NOVA MEMORIAL again, you will need to register an account on the Platform again. No data, information, or content is preserved upon the deletion of your account on NOVA MEMORIAL and cannot be restored once deleted.

5. SUBSCRIBED USER

Subscribed Users are those Users on NOVA MEMORIAL who have paid NOVA MEMORIAL at least one subscription - monthly, annual, or lifetime - to have full and unlimited access to the capabilities of the Platform and Services available for one memorial page/digital memorial book. One subscription is valid and provides access to the functionalities of the Platform only for one memorial page/digital memorial book. For example, if you wish to create your digital memorial book with your personal memories and keep important events for you in a larger volume of content, photos, and information, but also wish to create a memorial page for a deceased relative and have unlimited capability to create content, add photos, etc., you must pay for two separate subscriptions according to the conditions and prices specified on the Platform.If you are not a Subscribed User, there may be certain restrictions on the information and content you can create and share on NOVA MEMORIAL. These restrictions apply separately to each memorial page/digital memorial book you create in your Account.Subscribed Users may receive a special memorial plaque containing a unique QR code as a gift, which can be linked to a memorial page created by the Subscribed User.To become a Subscribed User, you need to choose one of the offered subscription plans, subscribe, and pay the price of the selected subscription by one of the payment methods indicated on the Platform. Please note that payments for all subscription plans are due and payable in advance. By choosing a subscription plan and paying its price, you expressly agree that the entire amount of the selected subscription plan will be paid by you in advance. NOVA MEMORIAL is not obligated to refund advance payments.If you do not pay the amount due according to the selected subscription plan within the respective deadlines, please note that your access to the content created in your Account will be limited to the options available for the free plan, and you will lose your status as a Subscribed User until you pay the due amount for the respective subscription plan.You should be aware that NOVA MEMORIAL integrates partner services to provide all the offered Services in full.NOVA MEMORIAL is not responsible for the services provided by partners - suppliers of integrated services, nor does it guarantee their quality and continuity. The terms of use of all integrated services depend entirely on the respective supplier. You should be aware that you may be required to provide additional data, consents, documents, and information at the discretion of the respective partner.

6. THE SERVICE OF NOVA MEMORIAL

NOVA MEMORIAL provides you with various opportunities for posting information about yourself and your deceased relatives and ancestors, creating, exchanging, and sharing content (memories) about you and/or your relatives, as well as opportunities for creating a family tree. NOVA MEMORIAL also offers an innovative way of presenting information about deceased persons on the Platform via a link (QR code) placed on the tombstone or plaque of the person. The terms of ordering our special memorial plaques containing a unique QR code via the Platform are specified in Appendix No. 1, which is an integral part of these Terms. Please familiarize yourself with the order terms before ordering memorial plaques via the Platform.The goal of NOVA MEMORIAL is to facilitate the creation of family heritage and the preservation and access to memories of deceased relatives and ancestors, including allowing Subscribed Users to create a family tree for all their relatives.Only Subscribed Users pay a fee to NOVA MEMORIAL in the form of a subscription - monthly, annual, or lifetime. The specific final prices and payment methods for the types of subscription plans are described on the Platform.Through NOVA MEMORIAL, once you have registered your account, you can post memorial pages, create digital memorial books, and share these memorial pages and digital memorial books with other Users on NOVA MEMORIAL. NOVA MEMORIAL allows you to post, at your discretion, texts, photos (including in combination with text) that have a title, description, and cover photo. These posts on NOVA MEMORIAL are called memorial pages and digital memorial books, depending on whether you are creating content for your deceased relatives and ancestors or for your personal memories and experiences.To provide the best possible Services to each of our Users on NOVA MEMORIAL, we use various algorithms to present your memories of you and your relatives and ancestors, stories, and family heritage in the most accessible way on NOVA MEMORIAL.Some of the features of NOVA MEMORIAL are available if you are a Subscribed User – for example, you can create a complete family tree without limitations in family relationships and degrees of kinship only if you are a Subscribed User.NOVA MEMORIAL provides the ability to create and share any articles (memorial pages/digital memorial books) and maintain blog-type content. The number of characters that a memorial page/digital memorial book can contain, the number of images, and other parts of the content of a memorial page/digital memorial book may be limited if you are not a Subscribed User.As a User, you have the freedom to determine the audience that can access the content you share – you have the right to share your content publicly (with all Users on NOVA MEMORIAL), and you also have the right to limit the Users who can access your content.NOVA MEMORIAL provides you with the opportunity to transfer ownership of the content you create to another registered User who can administer your content.
AdvertisementsNOVA MEMORIAL may provide opportunities for advertising. Ads are always created as publicly accessible content, should be targeted to a specific group, and should be paid for at a specified price on NOVA MEMORIAL.
PromotionsWe may offer discounts for the Services in accordance with Bulgarian law and rules we have defined for the respective promotional campaign. The rules applicable to such discounts are available where the discount is shown on the Platform. Discounts may be provided in various forms (e.g., promotions, promo codes, loyalty discounts provided individually on a random basis, or as a result of participating in a prize game, etc.).

7. YOUR COMMITMENTS

In exchange for our commitment to provide you with the Services, we expect you to adhere to the following commitments to us and other Users on NOVA MEMORIAL:
MEMORIAL to be as open and accessible as possible and to provide numerous opportunities for exchanging information and posting content related to memories of relatives and family connections, but we also want it to be safe, secure, and in compliance with the law, moral rules, and good practices. Therefore, we expect you to adhere to certain restrictions to be part of NOVA MEMORIAL and to use the Services fully, namely:
• You must be at least 18 years of age;
• You must not be prohibited from using our Platform under applicable laws;
• Your account must not have been deactivated for violating the law or the Terms and/or policies of NOVA MEMORIAL;
• You must not impersonate others or provide inaccurate and/or false information either about yourself or your relatives for whom you create memorial pages:
In this regard, you are not required to disclose your identity on NOVA MEMORIAL, but you must provide us with accurate and up-to-date information about yourself (during account registration or later) that may include your personal data. You must not impersonate a Third Party or create an Account for someone else without their express permission or explicit assignment. You are not allowed to create memorial pages for persons who are not your relatives, i.e., who are not your spouse, sibling, parent, grandparent, etc. When creating a memorial page, you must provide accurate and up-to-date information about your relative for whom you are creating the page. Note that we may require you (during the creation of a memorial page or later) to provide documents (including official documents such as certificates of heirs, certificates of kinship, and other similar documents) proving your relationship (e.g., kinship) with the person for whom you created the memorial page.
• When using NOVA MEMORIAL, you must not engage in any illegal, misleading, fraudulent, offensive, defamatory, or illegal or unauthorized actions.
• You must not violate (or assist or encourage others to violate) these Terms or applicable law.
You must not introduce, load, store, distribute, use, transmit, provide, or publish on NOVA MEMORIAL links to information as well as data, text files, software, photos, videos, or audio materials, messages, as well as any other materials and content:
1. that contradict applicable law, violate copyrights, trademarks, or other intellectual property rights, violate the rights and freedoms of a person under the Constitution of the Republic of Bulgaria and applicable Bulgarian and international legal acts of the European Union law or violate the rights of any third party;
2. that propagate discrimination, fascist, racist, or other anti-democratic ideology;
3. that damage the good name and reputation of others and call for violent change of the constitutional order, committing a crime, violence, or incitement to racial, national, ethnic, or religious hatred or animosity;
4. that violate property or non-property rights of third parties, including copyright and related rights;
5. ​that contain pornography, sexual violence, as well as links to websites or web pages with such content;
6. that contain computer viruses, Trojan horses, exploits, or other malicious code or software;
7. misleading and false materials or websites with the purpose of fraud and improper acquisition of information.
• You may not perform any actions that would hinder or disrupt the functioning of the Platform. This includes, but is not limited to, abusing reporting, disputing, or appealing channels, for example, by submitting fraudulent or misleading reports or signals;
• You may not attempt to create accounts, access, or collect information in unauthorized ways, including creating accounts or collecting information in an automated manner without explicit permission from NOVA MEMORIAL or in violation of these Terms and/or other policies and rules of NOVA MEMORIAL.
• You may not sell, license, or purchase accounts or data obtained from us or our Platform. This includes, but is not limited to, attempts to buy, sell, or transfer any aspect of your account (including your username); requesting, collecting, or using login credentials or badges from other users; or requesting or collecting usernames, passwords, or claiming access codes on NOVA MEMORIAL.
• You may not post someone else's personal or confidential information without permission or engage in anything that violates someone else's rights, including intellectual property rights (e.g., copyright infringement, trademark infringement).
• You may use someone else's works under exceptions and limitations of copyright and related rights according to applicable laws. You confirm that you own or have obtained all necessary rights for the content you post or share.
• You may not modify, translate, create derivative products, or reverse engineer our products or their components without our prior written consent.
• You may not use a domain name or URL address in your username without our prior written consent.
• In all cases, you are responsible and obligated to indemnify us for all lost profits, damages, and losses you have directly or indirectly caused to NOVA MEMORIAL as a result of violating the law, the rights of Third Parties, or these Terms, including by performing operations through the Platform with improper, illegal, or contrary to these Terms use of NOVA MEMORIAL.
• You are obligated not to publish materials containing viruses or other programs aimed at destroying or damaging NOVA MEMORIAL or another system, as well as materials with prohibited, obscene, defamatory, threatening, or malicious content. NOVA MEMORIAL reserves the right to remove and/or edit such materials. In case of failure to comply with these obligations, you will owe us compensation for damages and lost profits for each violation separately.
• In case of unlawful and unauthorized use of NOVA MEMORIAL, you are responsible for the material and non-material damages caused to NOVA MEMORIAL. If such actions are found, we have the right to suspend the provision of the Services and stop your access to your account and/or the Platform without being responsible for damages or data loss on your part and without owing you notification or warning. Unauthorized use is also present when actions are performed during the use of NOVA MEMORIAL, including the use of software or other means that hinder the operation or interfere with the normal functioning of the NOVA MEMORIAL equipment, as well as the dissemination of information that violates legal provisions, the rights of Third Parties, or these Terms of Use.

8. PERMISSIONS YOU GRANT TO NOVA MEMORIAL

To provide you with the Services and to use NOVA MEMORIAL to the fullest extent, you need to grant us some permissions:
NOVA MEMORIAL does not acquire ownership of your content, but you grant us the right to use it. In this regard, please note that nothing changes regarding your rights to the content you post on NOVA MEMORIAL. You are free to share your content with anyone whenever and wherever you choose, at your discretion, and in a way chosen by you. NOVA MEMORIAL needs you to grant certain permissions (often referred to as "license" or "right to use") to provide the Services to Users. When you share, post, or upload content covered by intellectual property rights (such as photos or videos) under these Terms of Use, you grant us a non-exclusive, royalty-free, transferable, sub-licensable, and worldwide right (license) to host, use, distribute, modify, reproduce, copy, publicly perform or display, translate, and create derivative works of your content (in accordance with your Account settings on NOVA MEMORIAL). This license terminates when your content is deleted from NOVA MEMORIAL. You can delete your content individually or all at once by deleting your Account at any time you decide.
Permission to use the content available in your Account: You grant us permission to display created memorial pages (or parts of them), family tree, comments, likes, etc., or relationships (such as followings) directly or in connection with Profiles, advertisements, offers, and other exclusive content you follow or interact with, which are displayed on NOVA MEMORIAL without any compensation to you. As with actions regarding other content and following other profiles, actions regarding sponsored content and following sponsored profiles can only be seen by people who have permission to see that content or follow.
Additional Rights We Reserve
If you choose a username or similar identifier for your account, we may change it if we deem it appropriate or necessary (for example, if it infringes on someone else's intellectual property rights or impersonates another User).
If you use content subject to our intellectual property rights, which we have and make available on the Platform (such as images, texts, designs, videos, or sounds provided by us that you add to the content you create or share), we retain all rights to our content (but not to your content).
You may use our intellectual property objects and trademarks or other similar signs only as expressly permitted within NOVA MEMORIAL or with our prior written consent.
You must obtain written permission from us or permission under an open-source license to modify, create derivative products, decompile, or otherwise attempt to extract the primary code from us.

9. REMOVAL OF CONTENT AND PROHIBITION OR TERMINATION OF YOUR ACCOUNT ON NOVA MEMORIAL

   We may remove or restrict any content or information you share within the Platform if we believe it violates these Terms of Use or if we need to do so under a legal act and/or act of a state or administrative authority. We may refuse to provide or terminate the provision of all or part of the Service (including suspend or deactivate your access to NOVA MEMORIAL) immediately to protect our community or services, or if you create a risk or legal liability for us if you violate these Terms of Use if you repeatedly violate the intellectual property rights of others, or when required by law. We may also suspend or change the Platform, remove or block content or information shared on the Platform, or stop providing Services or parts thereof if we deem it reasonably necessary to prevent or mitigate adverse legal or regulatory impacts on us. In some cases, when we remove content, we will notify you and explain all the options you have to request another review unless you seriously or repeatedly violate these Terms or if this action may put us or others at risk, including engaging in legal responsibility, harming our community of Users, compromising or disrupting the integrity or functioning of some of our Services, systems, or products; when we are limited due to technical restrictions; or when there is a prohibition to act in this way due to legal reasons. If you believe your Account was suspended by mistake or you want to prohibit or delete your Account permanently, contact us or use the functionalities available on the Platform. When you submit a request to delete content or your Account, the deletion process will start automatically no more than 30 days after the request is submitted. Deleting content may take up to 90 days after the deletion process begins. While the content deletion process is in progress, the content is no longer visible to other Users but remains subject to these Terms of Use and our Privacy Policy. Once the content is deleted, it may take us another 90 days to remove it from backup copies.

10. ADDITIONAL TERMS

1. If you use certain other features or related services available on the Platform, you will be given the opportunity to agree to additional terms that will also become part of our agreement. For example, if you use payment features, you may be asked to agree to the terms of payment of our partner - the payment service provider.
2. If any part of this agreement is unenforceable, the remaining parts will remain in force.
3. We reserve all rights not expressly granted to you.
4. Our rights and obligations may be assigned to others. This may happen, for example, in the event of a change in our ownership (merger, acquisition, or sale of assets) or by law.
Who is responsible if something happens:
We will exercise due care and reasonable efforts in providing access to and use of the Platform and our Services and in maintaining a safe, secure, and trouble-free environment, but we cannot guarantee that the Platform and our Services will always operate without errors, delays, or defects. Provided we have exercised due care and reasonable efforts, we are not responsible for: losses not caused by our breach of these Terms or otherwise by our actions; losses not reasonably foreseeable by you and us at the time of accepting these Terms; any offensive, inappropriate, obscene, unlawful, or otherwise objectionable content posted by a third party that you may encounter on NOVA MEMORIAL; and other actions and/or events beyond our control.
NOVA MEMORIAL is distributed and provided for use in an "as is" condition, and we do not guarantee that the Platform and/or Services will meet all your needs and requirements. By creating your account, you declare that you have verified and are satisfied that the various functional capabilities of the Platform and Services meet your needs and requirements, which you confirm and validate by creating your account and accepting these Terms of Use. We do not guarantee that you will achieve certain goals and results through NOVA MEMORIAL.
You understand and agree that our intention is to provide the NOVA MEMORIAL Platform so that it is compatible with current versions of all operating systems and browsers. However, we exclude any warranties that NOVA MEMORIAL is compatible with any operating system, computer platform, or browser you may choose to use. We also do not guarantee that NOVA MEMORIAL, including any future modification, update, improvement, or new version of NOVA MEMORIAL, will be compatible with the new versions of the operating system, computer platforms, and browsers you use.

11. UPDATING THESE TERMS OF USE

    We have the right to change the Platform, our Services, and policies, and it may be necessary to make changes to these Terms so that they accurately reflect the current functionalities and capabilities of the Platform, our Services, and/or policies. Unless otherwise required by law, we will notify you (for example, through a message on the Platform) at least 30 days before making changes to these Terms, providing you with the opportunity to review them before they take effect. If you continue to use the Platform and Services after that, the updated Terms will be binding on you. If you do not wish to agree to these or other updated Terms, you can delete your account.

12. SEVERABILITY

    If any part of these Terms is declared void, invalid, or unenforceable, it does not invalidate the entire Terms as a whole.

13. APPLICABLE LAW AND COMPETENT COURT

2. TECHNICAL STEPS FOR CONCLUDING A PURCHASE-SALE CONTRACT. PRICES. DELIVERY.

Users can use the Platform interface to conclude purchase-sale contracts for the goods offered by Nova Memorial - special personalized memorial plaques.

Users conclude the purchase-sale contract for the goods on the Platform by following the mandatory steps and functionalities of the Platform:

1. Logging into the system (shopping cart) to place orders on the Platform by identifying with a name and password or in one of the possible ways (Facebook or Google);
2. Selecting one or more of the offered goods and adding them to the shopping list;
3. Providing delivery details: delivery address; two names, email, and phone number of the contact person;
4. Providing the necessary data depending on the chosen payment method - payment by card;
5. Reviewing the order;
6. Confirming the order.

Separate purchase-sale contracts are concluded between you and Nova Memorial as the supplier for the goods you have ordered, regardless of whether they were selected with a single electronic statement and from a single shopping list.

Nova Memorial may organize the simultaneous and combined delivery of the goods ordered under separate purchase-sale contracts.

The rights of each User concerning the delivered goods are exercised separately for each purchase-sale contract. Exercising rights concerning delivered goods does not affect or have an impact on the purchase-sale contracts for other goods.

Nova Memorial has the right at its discretion to refuse to fulfill an order, for which Nova Memorial notifies the User promptly without being obligated to specify the reason for the refusal.

The price for the separate purchase-sale contracts is paid at once when ordering the goods.

The prices of the offered goods are those listed on the Platform at the time of placing the order, except in cases of obvious error. In the case of an obvious error, Nova Memorial reserves the right to receive the actual price of the ordered goods.

By ordering the goods, the User agrees to pay the price of the goods and the delivery price separately from the goods price when such is due under these Terms.

The prices of the goods are in the currency indicated on the respective product page on the Platform and are final prices including all taxes and fees, including value-added tax.

The final due price represents the total price of all individual goods the User has ordered plus the delivery price if such is due.

The cost of delivery is included in the price of the goods.

Nova Memorial reserves the right to change the prices of the goods offered on the Platform and/or the delivery price at any time without notice, such changes will not affect already confirmed orders.

Nova Memorial may provide discounts for the goods offered on the Platform in accordance with Bulgarian law and rules defined by Nova Memorial. The rules applicable to such discounts are available where the discount is shown. Discounts may be provided in various forms (e.g., promotions, promo codes, loyalty discounts provided individually on a random basis or as a result of participating in a prize game, etc.).

Nova Memorial fulfills orders within the timeframes and at the prices according to its delivery policy.

You, as a consumer, at the time of order confirmation, expressly agree and accept that the service is activated immediately after payment and that you lose your right to withdraw once the service usage begins, regardless of whether you have performed active actions in using the service. You expressly give your prior consent and accept the execution of the contract to begin before the expiration of the withdrawal period. You, as a consumer, understand that by giving consent for the contract execution to begin, you will lose your right to withdraw from the purchase-sale contract for goods.

The services for which payment is due are activated upon payment, and therefore Nova Memorial does not owe a refund for a paid service regardless of whether the User has actively used the service.

By accepting these general terms, the User declares that they have been provided with information and are familiar with:

1. The name and address, as well as all other identifying data of Nova Memorial;
2. All characteristics of the goods and services provided by Nova Memorial;
3. Information about the composition, packaging, purpose, and use of the goods and services provided by Nova Memorial;
4. Availability of the goods;
5. The risks associated with the usual use, application, or maintenance of the goods;
6. The final price of the goods and the price for their delivery, including all taxes and fees;
7. The payment, delivery, performance conditions, the date by which the Supplier undertakes to deliver the goods;
8. The conditions, term, and manner for making complaints and withdrawals;
9. The period for which the goods' price is valid;
10. The conditions and term of the warranty/validity;
11. Contact information with the supplier, including by phone and email;
12. The technical steps for concluding the contract and their legal significance;
13. The technical means for identifying and correcting errors in entering information before making the contract statement;
14. The User's consent with these Terms will be stored electronically, and a separate paper contract will not be stored by Nova Memorial;
15. The contract with the supplier is concluded in Bulgarian;
16. The supplier is registered under the VAT Act.

The user gives their consent for concluding a distance contract, as well as for advance and preliminary payments for the delivery of the goods.
